 Common Violations & How to Avoid Them

We understand that no one likes to get a violation notice, but unfortunately, there are times it has to be done to maintain the community.  If you’re not sure what the rules and regulations are, please refer to the Covenants, Conditions and Restrictions (CC&R’s) and Architectural Guidelines. The first violation notice is a courtesy notice of the issue, and residents are given time to correct it.   If the violation is not cured, then subsequent notices will be sent out and you may be fined.  To help prevent a violation, here is a list of some of the most common violations to avoid.
Exterior Maintenance:

  • Light fixtures are often overlooked, but they still must be maintained.   They are exposed to the weather and will deteriorate fast.  They should be cleaned up, and properly painted or oiled, and not in disrepair.    
  • Mailboxes are severely rusted, missing hardware clips, or have damage resulting in dents.  Also check the brick/stone to ensure your mailbox is in an upright position as best as possible as ground shift has affected many.  They should also be cleaned up as some have mold, moss, or mildew growing on the brick.  Pressure washing with vinegar and water can bring your mailbox into compliance, while enhancing curb appeal.
  • Fencing with significant weathering must be stained/re-stained, and all pickets must be in good condition, while the posts face the inside of your backyard.  Many residents were affected by last year’s hail storm and now have fencing with hail damage, or leaning panels.  It is possible to reduce/minimize the hail damage using a pressure washer, but staining may also be required.  Others have sprinklers that have caused discolored pickets where the stain has faded.  Also, if you have replaced pickets but did not stain them, yet the majority of your fence is stained, please make arrangements to stain the new pickets the same color.  ** If you want to change stain color, please submit an ACC Request through the NMI web portal and provide the stain color of your choice.  The committee will review.
  • Landscape borders must be properly installed, and must be maintained.  There shouldn’t be large or excessive cracks in the mortar, and stones/bricks should not be missing, broken, or tossed to the side.
  • Shutters and wood columns should be inspected annually.  Some of the homes are in direct sunlight which speeds up the deterioration causing extreme fading of the stain.
  • Address block on the home:  Over time, they become weathered and the paint begins to fade.  These numbers should be clearly visible, and painted properly.  Emergency personnel need to see those numbers quickly.
 
Landscaping:
  • Dead Plants and/or Shrubs: Many of the plants and shrubs in the flower beds, and the tree rings are dead.  Please remove those asap.  Replacements must be done as soon as weather permits, however the dead material must be taken out.  Also trees that are no longer growing from the top half, but have shoots growing from the bottom must be removed.  The tree is technically dead, and those shoots are not going to grow into a tree.  Tree replacement is encouraged but not required.
  • Tree Trimming: Trees must be checked annually to ensure they are healthy, and diseased limbs should be removed.  Tree limbs should not be encroaching on a neighboring lot or encroaching into the street, and any trees along the sidewalk should provide at least a 6 feet clearance to allow safe passage of pedestrians. 
  • Flower beds and tree rings full of grass/weeds:   Advice from a professional landscaper stated "Dimension" is a great pre-emergent to stop the grass/weeds and will not harm your (ornamentals) shrubs.
  • Weeds in the lawn:  The lawn must be free of weeds.   A pre-emergent is going to stop new growth and will keep your lawn from spiraling out of control when Spring hits.  Landscapers are advising to apply a pre-emergent in January, and another in March.  This is due to the higher temperatures Texas has in November and December and the noxious weeds will not completely hibernate. This will bring a large amount of weeds once ground temps reach 55.  Recommended product is Prodiamine 0-0-7.

Other Common Violations:
  • Holiday Decorations: Remove Holiday Decor within 30 days after the holidays ends.  The decorations were great, but it's time to take them down.  Make sure to take the light clips off the home as well.  " Holiday" refers to those in which colored lighting is traditionally displayed (Halloween/Christmas).
  • Trash/Recycle bins must be stored out of street view which means they cannot be stored in the driveway, or on the side of the home unless you have an approved screen in place.  Otherwise, bins need to be behind the fence line, or in the garage on a non-collection day.  Also, please do not place your bins on the curb for pick up any earlier than 6pm the evening before, and make sure to store them no later than midnight of collection day.  Trash must be bundled properly inside the bin so that it does not blow out into the neighborhood.
  • Vendor Signs:  Vendor signs such as roofing, and pool signs are prohibited.
  • Parking: The following are prohibited, but not limited to: commercial vehicles, boats, trailers, RV's, campers, recreational vehicles, inoperable vehicles, or vehicles undergoing restoration. They must be out of public view. Vehicles parked in the driveway should not block the public sidewalk as that prevents safe passage for pedestrians.  If vehicles appear stored on the street, or if they are illegally parked (against flow of traffic, too close to a stop sign or fire hydrant), please contact the local police non-emergency line at 817-392-4222.  They will need the license plate info, and the make/model/color of the vehicle.
  • Exterior modifications to your home or lot (front or back), including the installation of playground equipment, sheds, patio covers, decks, and more must be approved by the HOA’s Architectural Control Committee prior to installation.  If you are unsure if approval is needed, please email CustomerCare@nmitx.com.  It's better to be safe than sorry!

If you receive a violation and feel it's in error, or you need more time to resolve, please email CustomerCare@nmitx.com.  The goal is not to fine residents, but to bring residents together to better the community and raise property values for all.


REPORTING VIOLATIONS

Reporting to the HOA:  Residents can report potential violations to CustomerCare@nmitx.com. All reports are anonymous.  The HOA will need the nature of the violation, date it occurred, address of the violator, and a photo if possible.   Please note, you will not receive a follow up as to the status of the violation because the HOA cannot legally provide that information to you.

Fort Worth Code Compliance:  Code Compliance with Fort Worth can help resolve situations that are in violation of the city’s code compliance.  They typically address the issue within 48 hours of a report.  Residents can report anonymously also!  Fort Worth offers Code Compliance reporting via the MyFortWorth app for mobile devices, or online at https://www.fortworthtexas.gov/departments/code-compliance/online-code-reporting. ​
